These Terms of Service ("Terms") are offered by Naturia Nutrition, trading as Naturia Nutrition, ("Naturia,""Try Naturia," "we," "us," or "our").

These Terms include a limitation of liability, a limitation on the time to bring a claim, and a class-action waiver (applied only where permitted by law). They do not exclude, restrict, or modify any consumer guarantee, warranty, or other right you have under laws that cannot be excluded, including the Australian Consumer Law, the UK Consumer Rights Act 2015, applicable Canadian provincial consumer protection legislation, and applicable United States federal and state law. Where any part of these Terms conflicts with those rights, those rights prevail.

This website is operated by Naturia. Naturia offers this website, including all information, tools, products, and services available from this site (collectively, the "Services"), to you, the user, conditioned upon your acceptance of all terms, conditions, policies, and notices stated here.

By visiting our site and/or purchasing something from us, you engage in our "Service" and agree to be bound by these Terms, including the additional terms, conditions, and policies referenced herein and/or available by hyperlink. These Terms apply to all users of the site, including browsers, vendors, customers, merchants, and contributors of content.

Please read these Terms carefully before accessing or using our website. Our store is hosted on Shopify Inc., which provides us the online e-commerce platform that allows us to sell our products and Services to you.

We reserve the right to update, change, or replace any part of these Terms by posting updates and/or changes to our website. If changes are material, we will provide reasonable notice via email, account notification, or website banner. Your continued use of or access to the website following the posting of any changes constitutes acceptance of those changes.

Section 1 — Online Store Terms


By agreeing to these Terms, you represent that you are at least the age of majority in your country, state, or province of residence, or that you are the age of majority and have given us your consent to allow any of your minor dependents to use this site.

You may not use our products for any illegal or unauthorized purpose, nor may you, in the use of the Service, violate any laws in your jurisdiction (including but not limited to copyright laws). You must not transmit any worms, viruses, or any code of a destructive nature.

You further agree that all products purchased from us are intended for personal use only and not for resale, redistribution, export, or commercial use unless expressly authorized by us in writing. We reserve the right to refuse or cancel any order that we believe, in our sole discretion, may involve unauthorized resale, distribution, or misuse of our products or brand.

Section 2 — General Conditions


We reserve the right to refuse Service to anyone for any lawful reason at any time.

You understand that your content (excluding credit card information) may be transferred unencrypted and may involve (a) transmissions over various networks and (b) changes to conform and adapt to technical requirements of connecting networks or devices. Credit card information is always encrypted during transfer over networks.

You agree not to reproduce, duplicate, copy, sell, resell, or exploit any portion of the Service, use of the Service, or access to the Service without express written permission from us.

We reserve the right to refuse, limit, or cancel orders, accounts, or access where we reasonably suspect fraud, abuse, unauthorized resale, deceptive conduct, or misuse of our products, brand, content, trademarks, product descriptions, testimonials, or marketing materials.

The headings used in this agreement are included for convenience only and will not limit or otherwise affect these Terms.

Section 3 — Accuracy, Completeness and Timeliness of Information


We are not responsible if information made available on this site is not accurate, complete, or current. The material on this site is provided for general information only and should not be relied upon or used as the sole basis for making decisions without consulting primary, more accurate, more complete, or more timely sources. Any reliance on the material on this site is at your own risk.

This site may contain certain historical information, which is not necessarily current and is provided for your reference only. We reserve the right to modify the contents of this site at any time, but we have no obligation to update any information.

For the avoidance of doubt, any information relating to health, supplementation, ingredients, or product usage is provided for informational purposes only and is not medical advice.

Section 4 — Modifications to the Service and Prices


Prices for our products are subject to change without notice. We reserve the right at any time to modify or discontinue the Service (or any part or content thereof) without notice. To the extent permitted by law, and subject to your non-excludable consumer rights, we shall not be liable to you or to any third party for any modification, price change, suspension, or discontinuance of the Service.

We may also modify product formulations, packaging, pricing, promotions, shipping methods, or availability at any time in our sole discretion.

Section 5 — Products; Regulatory Disclaimers; No Medical Advice


Certain products or Services may be available exclusively online and may have limited quantities, subject to return or exchange only according to our Refund Policy and your non-excludable statutory rights. We have made every effort to display as accurately as possible the colours and images of our products, but cannot guarantee that your device's display of any colour will be accurate.

We reserve the right, but are not obligated, to limit the sales of our products or Services to any person, geographic region, or jurisdiction, and to limit quantities. Any offer for any product or Service made on this site is void where prohibited.

Naturia products are dietary/food supplements. They are not intended to diagnose, treat, cure, or prevent any disease. The following country-specific notices apply according to your place of residence:


Australia: Products are supplied as complementary medicines/supplements consistent with the requirements of the Therapeutic Goods Administration (TGA) where applicable. Always read the label and follow the directions for use. If symptoms persist, talk to your health professional.


United States: These statements have not been evaluated by the Food and Drug Administration. This product is not intended to diagnose, treat, cure, or prevent any disease.


United Kingdom: Products are food supplements and are not medicines. Food supplements should not be used as a substitute for a varied, balanced diet and a healthy lifestyle. Do not exceed the stated recommended daily dose.


Canada: Products are natural health products regulated by Health Canada; where licensed, they carry a Natural Product Number (NPN) or Homeopathic Medicine Number (DIN-HM) on the label. Consult a healthcare practitioner prior to use.

All information on this website is for informational and educational purposes only and is not medical, legal, or professional advice. You should consult a qualified healthcare professional before using any product, especially if you are pregnant, nursing, taking medication, or have a medical condition. Individual results may vary, and we do not guarantee any specific results.

If a product is temporarily out of stock or unavailable after an order is placed, no payment will be captured for that item until it becomes available for shipment. We reserve the right to cancel or delay orders affected by inventory shortages, and customers will be notified accordingly.

Section 6 — Accuracy of Billing and Account Information


We reserve the right to refuse any order you place with us. We may, in our sole discretion, limit or cancel quantities purchased per person, per household, or per order, including orders placed under the same customer account, the same payment method, and/or the same billing or shipping address. In the event that we change or cancel an order, we may attempt to notify you using the email and/or billing address/phone number provided at the time the order was made. We reserve the right to limit or prohibit orders that, in our reasonable judgment, appear to be placed by dealers, resellers, or distributors.

Order confirmation does not constitute acceptance. We reserve the right to accept or decline any order at our discretion.

You agree to provide current, complete, and accurate purchase and account information for all purchases, and to promptly update your account information (including email address and payment details) so that we can complete your transactions and contact you as needed.

You are responsible for any chargebacks, reversed payments, or fees, and we reserve the right to recover funds, suspend services, or take further lawful action where necessary.

Section 7 — Payment and Authorization


All charges are processed in the currency displayed at checkout. Where you are shopping from Australia, the United States, the United Kingdom, or Canada, prices and charges may be shown and billed in your local currency or in Australian Dollars, as indicated at checkout. Your bank or card issuer may apply currency conversion or foreign transaction fees for which we are not responsible.

By providing a payment method and submitting payment information, you represent and warrant that: (i) you are authorized to use that card or account; (ii) all payment information you provide is complete and accurate; (iii) you will be responsible for any payment card fees; and (iv) sufficient funds exist to pay the amounts due. You authorize Naturia to charge your payment method for products purchased, subscription renewals, shipping charges, applicable taxes, and any other disclosed fees. If payment is declined, we may suspend or cancel your order.

Account Updater. We and our third-party payment service providers may request and receive updated card information from your card issuer (such as updated card numbers and expiry dates) and update your account accordingly. If your payment information is updated, you authorize us to charge the updated payment method. Your card issuer may allow you to opt out of providing updated card information; to opt out, contact your card issuer, or remove your stored payment method or cancel any subscription.

Payments may be processed through third-party providers. Your use of such providers is subject to their terms and privacy policies. Naturia is not responsible for payment processor errors.

Section 8 — Shipping; Title; Risk of Loss


We ship to addresses in Australia, the United States, the United Kingdom, Canada, and select other international locations available at checkout. An accurate shipping address and phone number are required. We are not responsible for delays or non-delivery resulting from incorrect address information provided by you.

If you made a mistake with your order after submitting it, or wish to cancel before it has shipped, please contact Customer Support at support@trynaturia.com as soon as possible. We cannot guarantee that we will be able to amend your order.

Subject to your non-excludable statutory rights, and unless otherwise required by law, risk of loss passes to you upon delivery to the carrier. Shipping and delivery dates are estimates only. International customers are responsible for any customs duties and import taxes.

Section 9 — Delivery Confirmation


Delivery confirmation provided by the carrier is treated as strong evidence of delivery to the address you provided, even without a signature, for the purpose of resolving disputes such as chargebacks or claims of non-delivery. This does not limit any right you have under applicable consumer law in respect of goods that are not actually received.

Section 10 — Returns, Refunds & Cancellation Rights


Please review our Refund Policy, which is incorporated into these Terms by reference. Refunds, where applicable, are processed to the original payment method. Bank posting times vary.

Your statutory rights come in addition to our Refund Policy and are not affected by it:


Australia: Our goods come with guarantees that cannot be excluded under the Australian Consumer Law. You are entitled to a replacement or refund for a major failure and to compensation for any other reasonably foreseeable loss or damage, and to have goods repaired or replaced if they are not of acceptable quality and the failure does not amount to a major failure.


United Kingdom: Under the Consumer Contracts Regulations 2013 you generally have the right to cancel a distance purchase within 14 days of receiving the goods and obtain a refund. This right does not apply to sealed goods that are not suitable for return due to health protection or hygiene reasons once they have been unsealed after delivery. Your rights under the Consumer Rights Act 2015 (goods to be of satisfactory quality, fit for purpose, and as described) also apply.


Canada: You retain all rights available to you under the consumer protection legislation of your province or territory.


United States: You retain all rights available to you under applicable federal and state law.

To exercise a cancellation or return right, contact support@trynaturia.com. Unless otherwise stated in our Refund Policy or required by law, outbound shipping and handling fees are non-refundable.

Section 11 — Electronic Communications; Consent


By using the website, creating an account, or making a purchase, you consent to receive electronic communications from us, including order confirmations, shipping notifications, subscription reminders, customer service communications, and marketing communications (where you have opted in). You may opt out of marketing emails via the unsubscribe link in such communications.

You agree that electronic communications satisfy any legal requirement that such communications be in writing, to the extent permitted by law.

Section 12 — Personal Information; Privacy


Your submission of personal information through the store is governed by our Privacy Policy, which is incorporated into these Terms by reference. Our website uses cookies, pixels, and similar technologies operated by us and third parties to enhance user experience, analyze performance, personalize content, and support advertising and marketing. Please review our Privacy Policy for details, including how we handle personal information under the Australian Privacy Act, the UK GDPR and Data Protection Act 2018, Canada's PIPEDA, and applicable US state privacy laws.

Section 13 — Subscriptions; Automatic Renewal; Cancellation


13.1 Enrollment


The website may offer subscription options ("Subscription Services") that provide automatic recurring shipments at the frequency you select during checkout. If you enroll, you agree that your subscription includes recurring payment obligations and that Naturia is authorized to charge your payment method automatically at the selected billing interval until you cancel.

13.2 Disclosure and Consent


Before you complete enrollment, we will present a clear and conspicuous notice, in visual proximity to the request for your consent, disclosing: that your subscription will automatically renew and be charged on a recurring basis unless you cancel; the length of the renewal period; the amount and frequency of charges; the cancellation methods available; a direct link to the cancellation process; and our contact email, support@trynaturia.com. Your affirmative action constitutes express informed consent to the automatic renewal terms.

13.3 Automatic Renewal; Confirmation


UNLESS YOU CANCEL, YOUR SUBSCRIPTION WILL AUTOMATICALLY RENEW AT THE THEN-CURRENT RATE AND AT THE BILLING INTERVAL YOU SELECTED. IF PRICING CHANGES, WE WILL PROVIDE ADVANCE NOTICE AS REQUIRED BY LAW. After enrollment, we will email you a confirmation summarizing the renewal terms, the amount and billing frequency, the cancellation methods, and a direct link to cancel. If you do not receive a confirmation within 24 hours, contact support@trynaturia.com.

13.4 How to Cancel


You may cancel at any time, and cancellation is at least as easy as enrollment. To avoid being charged for the next cycle, cancel at least twenty-four (24) hours before your next scheduled billing or shipment date.


Online: Log into your account/customer portal and follow the clearly labeled cancellation steps. No phone call required.


Email: Send a cancellation request to support@trynaturia.com. We will confirm within one (1) business day.

You will receive a cancellation confirmation by email. No further recurring charges will be processed and no additional shipments sent after the current billing cycle concludes.

13.5 Failed Payments


If a recurring charge fails, you authorize us to retry the charge, contact you for updated payment information, and suspend shipments until payment is received. Unpaid balances may be referred for collection where permitted by law.

13.6 California Subscriber Rights


If you are a California resident, the following additional disclosures apply pursuant to California Business and Professions Code Section 17600 et seq.: your subscription will automatically renew at the interval and then-current price you selected unless you cancel before the next renewal date; you may cancel at any time via your account portal or by emailing support@trynaturia.com, and we will not make it difficult to cancel; and if we fail to provide the required disclosures before enrollment, you may request a refund of unauthorized charges by contacting support@trynaturia.com. You may also contact the California Department of Consumer Affairs, Consumer Information Division, at 1625 N. Market Blvd., Suite N 112, Sacramento, CA 95834, (800) 952-5210.

Section 14 — Optional Tools and Third-Party Links


We may provide access to third-party tools "as is" and "as available" without warranties of any kind, and to materials from or links to third-party websites not affiliated with us. We are not responsible for the content or accuracy of, and have no liability for, any third-party materials or websites. Please review the third party's policies before engaging in any transaction. This does not limit your non-excludable statutory rights against us in relation to our own products.

Section 15 — User Comments, Feedback and Other Submissions


If you send creative ideas, suggestions, photographs, testimonials, reviews, comments, or other materials (collectively, "comments"), you grant us a worldwide, royalty-free, perpetual, irrevocable, transferable, sublicensable license to use, reproduce, modify, publish, distribute, display, and create derivative works from such comments in any medium for business and marketing purposes. We are under no obligation to keep comments confidential, to pay compensation, or to respond.

You represent that you own or control all rights in the comments, that they are truthful and not misleading, and that they do not violate any third party's rights. Your comments will not contain unlawful, abusive, defamatory, or obscene material, or any malware. You may not misrepresent the origin of any comments. You are solely responsible for the comments you make.

We may, but have no obligation to, monitor, edit, or remove content we determine to be unlawful, offensive, defamatory, obscene, or otherwise objectionable or in violation of these Terms.

Section 16 — Errors, Inaccuracies and Omissions


Occasionally information on our site may contain typographical errors, inaccuracies, or omissions relating to product descriptions, pricing, promotions, offers, shipping charges, transit times, or availability. We reserve the right to correct such errors and to change or update information, or cancel orders where information was inaccurate, at any time without prior notice (including after you have submitted your order), subject to your non-excludable statutory rights. Where we cancel an order you have already paid for, we will refund you in full.

Section 17 — Prohibited Uses


You are prohibited from using the site or its content: (a) for any unlawful purpose; (b) to solicit others to perform unlawful acts; (c) to violate any regulations, rules, or laws; (d) to infringe our or others' intellectual property rights; (e) to harass, abuse, harm, defame, or discriminate based on gender, sexual orientation, religion, ethnicity, race, age, national origin, or disability; (f) to submit false or misleading information; (g) to upload or transmit malicious code; (h) to collect or track others' personal information; (i) to spam, phish, spider, crawl, or scrape; (j) for any obscene or immoral purpose; or (k) to interfere with or circumvent the security features of the Service. We reserve the right to terminate your use of the Service for violating any prohibited use.

You are specifically prohibited from making false claims about our products, using our brand in deceptive marketing, or misrepresenting affiliation with Naturia.

Section 18 — Disclaimer of Warranties


Except as expressly stated by us, and subject to your non-excludable rights under the Australian Consumer Law, the UK Consumer Rights Act 2015, applicable Canadian provincial consumer protection legislation, and applicable US federal and state law, and to the maximum extent permitted by law:

We do not warrant that your use of the Service will be uninterrupted, timely, secure, or error-free, or that results obtained will be accurate or reliable. The Service and all products delivered through it are provided "as is" and "as available," without any representation, warranties, or conditions of any kind, either express or implied, including implied warranties of merchantability, merchantable quality, fitness for a particular purpose, durability, title, and non-infringement.

Nothing in these Terms excludes, restricts, or modifies any guarantee, warranty, term, or condition implied or imposed by law that cannot lawfully be excluded, restricted, or modified. Where such a guarantee applies and can be limited, our liability is limited (at our option) to replacing the goods, supplying equivalent goods, or paying the cost of doing so.

Section 19 — Limitation of Liability


To the maximum extent permitted by law, and subject to your non-excludable statutory rights, in no event shall Naturia or its owners, officers, employees, agents, contractors, suppliers, service providers, or licensors be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, including lost profits, lost revenue, lost savings, loss of data, or loss of goodwill, arising out of or relating to these Terms, your use of or inability to use the Service, any product purchase, any Subscription Service, or any marketing practices, whether based in contract, tort (including negligence), strict liability, warranty, or otherwise.

To the maximum extent permitted by law, and except in respect of liability that cannot be limited under applicable consumer law, Naturia's total liability for any and all claims shall not exceed the greater of: (a) the total amount you paid to Naturia in the twelve (12) months preceding the event giving rise to the claim; or (b) AUD $500 (or the equivalent in the currency of your purchase).

Some jurisdictions do not allow the exclusion or limitation of certain damages, so some of the above may not apply to you, and you may have additional rights.

Section 20 — Indemnification


You agree to indemnify and hold harmless Naturia and its owners, officers, agents, contractors, licensors, and service providers from any third-party claim or demand, including reasonable legal fees, arising out of your breach of these Terms, your misuse of the website or products, or your violation of any law or the rights of a third party. This clause does not apply to the extent a claim arises from our own negligence or breach, or is otherwise limited by applicable law.

Section 21 — Limitation on Time to File Claims


To the fullest extent permitted by law, and except where a longer period is required by applicable consumer law, any claim arising out of or relating to these Terms, the website, any product, or any Subscription Service must be commenced within one (1) year after the claim accrues, failing which it is permanently barred. This does not shorten any limitation period that cannot lawfully be shortened.

Section 22 — Dispute Resolution


22.1 Talk to us first


Most concerns can be resolved quickly. Before starting formal proceedings, please contact us at support@trynaturia.com with your name, order details, a description of the issue, and the outcome you are seeking. Both parties agree to attempt in good faith to resolve the matter for thirty (30) days after such notice.

22.2 Your local consumer rights


Nothing in these Terms deprives you of the protection of mandatory consumer laws of your country or state of residence, or of any right to bring proceedings in, or rely on the mandatory laws of, that jurisdiction where applicable law gives you that right. This includes access to any small claims court, tribunal, or consumer dispute scheme available to you (for example, a state or territory civil and administrative tribunal in Australia).

22.3 Class-action waiver (where permitted)


To the extent permitted by the law that applies to you, you and Naturia agree that claims will be brought only in an individual capacity and not as a plaintiff or class member in any purported class or representative proceeding. This waiver does not apply where it is prohibited or unenforceable under the law of your jurisdiction, and it does not limit any non-waivable statutory or representative right.

Section 23 — Governing Law and Jurisdiction


These Terms are governed by the laws of New South Wales, Australia, without regard to conflict-of-law principles. Subject to Section 22 and to any mandatory consumer rights that entitle you to bring proceedings elsewhere, you and Naturia submit to the non-exclusive jurisdiction of the courts of New South Wales, Australia. "Non-exclusive" means this does not prevent you from bringing a claim in the courts of your own country or state where applicable law gives you that right.

Section 24 — Intellectual Property


All website content — including text, images, graphics, trademarks, logos, software, and design elements — is owned by or licensed to Naturia and is protected by copyright, trademark, and other intellectual property laws. These Terms permit you to use the Services for your personal, non-commercial use only. You may not reproduce, distribute, modify, create derivative works of, or exploit any website content without our prior written consent. All rights not expressly granted are reserved.

Section 25 — Assignment


You may not assign or transfer these Terms or any of your rights or obligations under them without our prior written consent, and any such attempt will be void. Naturia may transfer, assign, or delegate these Terms and our rights and obligations without notice to you, including in connection with a sale of assets, reorganization, or by operation of law, provided your rights under these Terms are not materially reduced.

Section 26 — No Waiver


Our failure to enforce any right or provision of these Terms shall not constitute a waiver of that right or provision. Any waiver will be effective only if in writing.

Section 27 — Severability


If any provision of these Terms is determined to be unlawful, void, or unenforceable, that provision shall be enforceable to the fullest extent permitted by law, and the unenforceable portion shall be severed. This shall not affect the validity of the remaining provisions.

Section 28 — Termination


These Terms are effective unless and until terminated by either you or us. Obligations and liabilities incurred prior to termination survive. If you fail, or we reasonably suspect that you have failed, to comply with any provision of these Terms, we may terminate this agreement, and you will remain liable for all amounts due up to and including the date of termination. Provisions concerning intellectual property, disclaimers, limitation of liability, indemnification, time to file claims, dispute resolution, governing law, and payment obligations survive termination.

Section 29 — Entire Agreement


These Terms, together with our Privacy Policy and Refund Policy, constitute the entire agreement between you and Naturia and supersede any prior agreements. Any ambiguity shall not be construed against the drafting party.
